General Terms & Conditions

1. Scope
The general conditions of sale (hereinafter referred to as “GTC”) apply to all orders relating to products or services (activities offered) placed and contracts concluded (hereinafter referred to as “order”) via the online store. line of www.TENNIS-PLUS.ch (hereinafter referred to as “TENNIS-PLUS”). When confirming your order, you will be asked to accept the T&Cs. Acceptance of the T&Cs is a condition for processing your order. TENNIS-PLUS.ch reserves the right to modify the T&Cs. The version of the T&Cs valid at the time of the order applies. It cannot be changed unilaterally for the order in question.
2. Offer
The offer is valid as long as it appears in the online store, within the limits of stocks or available places. Changes in price, assortment and proposed activities are possible at any time. The images presented in advertisements, flyers, the online store, etc., as well as all the information concerning the products (list of ingredients or components, dimensions and specifications of the products, etc.) or the services (details on the proposed activities) serve as an illustration for information purposes only and are not contractual. The specific indications on the product packaging are decisive.
3. Price
Prices are in Swiss francs, net amounts, value added tax (VAT) included and guaranteed. If applicable, the advance recycling tax (TAR) is included. The prices indicated in the online shop at the time of the order are binding. Additional paid services such as delivery, specific packaging, etc., appear separately in the basket and on the order confirmation.
4. Availability
Our commitment to deliver products is void in the event of failure or non-compliance with deadlines. supply from our own suppliers, and insofar as this unavailability is not attributable to TENNIS-PLUS. In case of unavailability of a product, we will inform you as soon as possible. The proposed activities can be modified at any time by TENNIS-PLUS. Only the confirmation of registration for a group course, an individual session or an event is authentic. Despite all the efforts made to ensure the activities offered, TENNIS-PLUS may have to cancel an activity (for example if the minimum number of participants as indicated in the description of the activity is not reached, in the event of unforeseen absence of the organizer/coach/therapist, or, exceptionally, for logistical reasons of unavailable space). In the event of a canceled activity, we will inform you as soon as possible. The customer will recover his credit in the form of a credit from TENNIS-PLUS (see below).
5. Order
The display of products in the online store and of the activities offered on the TENNIS-PLUS website is not legally binding. This is an online catalog presented for information only, in order to invite customers to order the product or to book the activity through this means. TENNIS-PLUS reserves the right to restrict delivery quantities for certain products. A minimum amount applies to each order. The minimum amounts communicated in the online shop apply. During the first order, the total amount of the basket must not exceed Fr. 1,000.– (payment by credit card). After transmission of the order, the customer automatically receives an acknowledgment of receipt, which confirms that the order has indeed reached TENNIS-PLUS. The customer can no longer complete or cancel his order once it has been processed. TENNIS-PLUS may, without justification, refuse all or part of the order. In this case, the customer is informed and any payments already made are refunded. Any other claim is excluded, in particular products that are not available are not delivered later. Products temporarily unavailable cannot be reserved.
6. Conclusion of contract
The contract is concluded after processing the order, when the customer receives an order confirmation by e-mail.
7. Payment options
TENNIS-PLUS accepts payments by Visa and Mastercard credit cards, as well as payments by TWINT.
8. Delivery
≡ DELIVERY AREA
The customer’s delivery address must be in one of the countries visible on the drop-down list at the time of the order. The list of countries where deliveries are possible may be modified at any time by TENNISPLUS.ch.
≡ MODE, TIMES AND DELIVERY COSTS
All deliveries of orders made on TENNIS-PLUS.ch are delivered by post, regardless of the delivery zone. Deliveries are made within 5 to 8 days in Switzerland and 5 to 20 days in any other country. The delivery costs of the Swiss Post Ltd, communicated in the online shop of TENNIS-PLUS.ch, apply. The delivery costs are listed in the shopping cart and on the order confirmation that the customer receives by email as an additional position. TENNIS-PLUS does not deliver its parcels to post office boxes and does not deliver any goods to minors or customers under guardianship, except with the written authorization of the parents or guardian.
≡ DELIVERY TO A TENNIS-PLUS COLLECTION POINT
It is possible to request free delivery of orders to a TENNIS-PLUS partner sports center or tennis club, the evolving list of which can be found under: https://tennis-plus.ch/language/fr/contact-us- french/. To do this, the customer chooses the TENNIS-PLUS pick-up point as the delivery address. After delivery of the order to the TENNIS-PLUS collection point, the customer receives a collection notice by e-mail with a collection slip. The withdrawal slip serves as a means of legitimation and must imperatively be printed for the withdrawal or presented on the mobile phone. The code present on the withdrawal slip can also be presented separately. No additional identification will be made. Without this withdrawal slip, the order cannot be delivered to the customer. The withdrawal slip is validated at the TENNIS-PLUS withdrawal point, an operation considered as withdrawal certificate. The customer is invited to confirm the withdrawal of the goods by his signature. Any liability is expressly disclaimed for damages suffered by the customer in the event of loss, theft, misuse, etc., in connection with the withdrawal process or the withdrawal slip. The order must be collected within 10 working days of receipt of delivery confirmation. Any order that is not withdrawn within this period cannot be kept or refunded.
9. Legal guarantees
TENNIS-PLUS offers a two-year warranty against defects in material or workmanship for all products. The warranty period begins upon delivery of the product. It is possible that a product ordered via the online store is defective, despite the care that TENNISPLUS deploys to check the good condition of the products delivered. There is no general right of return on products without defects and correctly delivered, nor refunds on the services that the customer has reserved and to which he would not have gone when the activity took place (group lessons, individual sessions or events). The condition of the products delivered must be checked without delay, upon receipt of the products. You are required to notify us in writing of any visible defect or anomaly, as well as any discrepancy with respect to the order placed within 7 days of delivery by using the following email address (contact@tennis-plus.ch). If you fail to notify us of a defect within the aforementioned period, the product will be considered accepted and it will no longer be possible to assert the guarantee. The products must be returned intact and complete in their original packaging (with the labels bearing their references), accompanied by the delivery slip, within 7 days of receipt of your package at the address that we will indicate to you. Return shipping costs are your responsibility. Upon receipt of the returned product and after verifying the existence of the defect, TENNIS-PLUS.ch will offer to send you, at its expense, a replacement product or credit the amount due to your customer account (including the back). Damage to the product resulting from use that does not comply with the intended use of the product is not covered by the warranty. Likewise, normal wear and tear of the product as well as damage caused accidentally are not covered by the warranty.
10. Force majeure
TENNIS-PLUS.ch assumes no responsibility in the event that TENNIS-PLUS.ch is prevented from executing the order due to a case of force majeure, whether it concerns products or services (activities offered ).
11. Limitation of Liability
Within the limits permitted by law, TENNIS-PLUS.ch declines all responsibility for any direct or indirect damage caused by a product purchased on the online store. Although TENNIS-PLUS.ch pays particular attention to the editing of the site, it is possible that it contains incorrect or incomplete information. TENNIS-PLUS.ch assumes no guarantee as to the completeness, accuracy or timeliness of the information on the site.
12. Refunds, credit notes, credit
If the customer is entitled to refunds or credit notes, they will be credited to the customer account in the form of vouchers and can be used for purchases at TENNIS-PLUS. Vouchers are valid for one year. TENNIS-PLUS vouchers cannot be sold or auctioned under any circumstances. Only one voucher can be used per order. Credit transfers between customers are not possible. Any registration for a training course or a wellness session is nominative and non-refundable.
13. Applicable law and jurisdiction
The applicable law is Swiss law, and any dispute will be dealt with by the competent courts of Broye and Nord Vaudois.
